1. Agreement to Terms
By accessing or using SwiftListAgent ("the Service"), operated by Mog Mints ("the Company," "we," "us"), you agree to be bound by these Terms of Service. If you do not agree, you may not use the Service.
The Service is intended for use by licensed real estate professionals, brokerages, and their authorized team members located in the United States.
2. Description of Service
SwiftListAgent is a software-as-a-service platform that uses artificial intelligence to generate listing marketing materials for real estate professionals. The Service includes AI-generated content (MLS descriptions, social media posts, email campaigns, video scripts, open house guides, and market analysis), PDF report generation, brand customization, and team management features.
3. Account Registration
To use the Service, you must create an account with a valid email address and password. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify us immediately if you become aware of any unauthorized use of your account.
You must provide accurate and complete information during registration. Accounts created with false or misleading information may be suspended or terminated.
4. Subscription Plans & Billing
The Service is offered through paid subscription plans (Starter, Pro, and Agency) with monthly or annual billing. Prices are listed on our pricing page and are subject to change with 30 days' written notice.
Subscriptions automatically renew at the end of each billing cycle unless canceled. You may cancel at any time through your dashboard; cancellation takes effect at the end of the current billing period. No partial refunds are issued for unused portions of a billing cycle.
The Pro plan includes a 7-day free trial. You will not be charged until the trial ends. You may cancel during the trial at no cost.
All payments are processed by Stripe. By subscribing, you also agree to Stripe's Terms of Service.
5. Acceptable Use
You agree to use the Service only for lawful purposes related to real estate marketing. You may not:
Use the Service to generate content that violates Fair Housing laws or any applicable anti-discrimination laws. Attempt to reverse-engineer, decompile, or extract source code from the Service. Share, resell, or sublicense access to your account or generated content as a standalone product. Upload malicious files, attempt to exploit vulnerabilities, or interfere with the Service's operation. Use automated scripts or bots to access the Service beyond normal usage patterns.
6. Content Ownership & License
Your content: You retain ownership of all property information, photos, brand assets, and other materials you submit to the Service.
Generated content: AI-generated marketing content produced by the Service is licensed to you for your commercial use in marketing the relevant property listing. You may use this content in MLS listings, social media, email campaigns, print materials, and presentations.
Our rights: We may use anonymized, aggregated usage data to improve the Service. We will never use your specific property data, photos, or generated content for marketing or promotional purposes without your explicit written consent.
7. AI-Generated Content Disclaimer
Content generated by the Service is produced by artificial intelligence and is provided as a starting point for your marketing materials. You are solely responsible for reviewing, editing, and verifying all generated content before publication or distribution.
AI-generated market analysis, pricing guidance, and comparable sales data are estimates based on the information you provide and should not be relied upon as a substitute for a professional comparative market analysis (CMA) or appraisal.
The Company is not responsible for any claims arising from your use of AI-generated content, including but not limited to inaccuracies, Fair Housing violations, or misrepresentations in published materials.
8. Fair Housing Compliance
The Service includes automated Fair Housing compliance checking to help identify potentially discriminatory language. However, this feature is a tool to assist you. It does not guarantee compliance with the Fair Housing Act or any state or local anti-discrimination laws. You remain solely responsible for ensuring all marketing materials comply with applicable laws.
9. Service Availability
We strive to maintain high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We are not liable for any losses resulting from service interruptions.
10. Limitation of Liability
To the maximum extent permitted by law, the Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, business opportunities, or goodwill, arising from your use of the Service.
Our total liability for any claims arising from the Service shall not exceed the amount you paid to us in the 12 months preceding the claim.
11. Termination & Data Retention
We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or fail to pay subscription fees. Upon termination, your right to use the Service ceases immediately.
You may request export of your data within 30 days of termination. After 30 days, your account, property data, brand assets, tone profile, and generated content are permanently deleted from our systems and backups. Payment records are retained separately as required by applicable tax and financial regulations.
If you submit a verified deletion request under GDPR, CCPA, or another applicable privacy law, we will permanently delete your personal information within 30 days, regardless of subscription status. See our Privacy Policy for additional detail on data rights.
12. Changes to Terms
We may update these Terms from time to time. Material changes will be communicated via email or in-app notification at least 30 days before taking effect. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
13. Governing Law
These Terms are governed by the laws of the State of Nevada, without regard to conflict of law provisions. Any disputes shall be resolved in the courts located in Clark County, Nevada.
